Fort Trumbull pollution trial winding down
In one of the two remaining lawsuits out of the 10 brought by the The Fort Trumbull Conservancy, the group claims the NLDC and city caused unreasonable harm to the environment - creating dust and water runoff and unnecessarily polluting landfills - during the demolition of dozens of homes and small businesses in the Fort Trumbull neighborhood. The NLDC and city contend they followed all applicable environmental laws and took steps to reduce pollution.
Last week, conservancy attorney Scott W. Sawyer called environmental researcher Kevin Gardner from the University of New Hampshire and Robert S. DeSanto, director of the Institute of Environmental Stewardship LLC of Waterford. Gardner compared the impact of removing debris using standard techniques with using alternative methods, noting that many materials are not retrievable after a building is demolished. He concluded that 5,990 tons of materials could have been salvaged and reused. DeSanto opined that the players, pressured by time and money objectives, failed to satisfactorily address how to minimize the environmental impacts.
On Tuesday, the defense called on a civil engineer from Cheshire who wrote the environmental impact evaluation of the project in 1999. Jeanine A. Gouin, vice president of Milone & MacBroom, testified that as a project that received state funds, the development plan had to comply with the state Environmental Protection Act. She said it was aired at a public hearing and reviewed by state agencies. A no-action alternative was considered, she said, but the city chose the option of pursuing economic development by creating large tracts of land suitable for development.
